Testing at Work: Drugs, Alcohol and Yes, COVID-19

Drug and alcohol testing has become one of the most sensitive subjects in Canadian Labour and Employment Law in recent years. Everyone recognizes that drinking alcohol or taking certain drugs impairs one’s capacity to work properly and, depending on the workplace, might result in significant injury, property damage, and liability. 

Legislation and policy require managers to provide their employees with a healthy and safe work environment. In the context of Drug & Alcohol and COVID-19, managers must remain informed of MOL, OHRT or orders, directions and guidance issued by the Public Service Occupational Health Program, Health Canada, and their own organizations. 

There are many different types of testing:
  • Alcohol - We have breathalyzers. 
  • Cannabis- Blood volume 
  • COVID-19-Swab test with kit

Not all testing is 100% effective however where the employer turns a blind eye and fails to confirm, they are opening a door for charges and fines.

Where an employee would be suspected of use or reported to be under the influence of a substance, how as an employer, could you identify and ensure the employee is in fact under the influence of mind altering substance? How could you ensure that the employee is not driving off the company’s property under the influence of alcohol or drugs?

Where suspected of Drug, Alcohol or COVID-19, we have training in place whereby employees report to the Supervisor/Employer, reducing the exposure to other workers. Possibly have the employee work from home, use sick days or government assistance.
